Job Summary

You will be the lead commercial legal counsel for NetApp’s Field and customer facing business in EMEA, reporting to the VP of Commercial Legal. You will advise and direct legal support pertaining to NetApp’s transactions and relationships with customers, suppliers, and channel and alliance partners. You will manage NetApp’s Field Legal team in EMEA and be responsible for ensuring the delivery of innovative, practical, forward-thinking, and cost-effective legal services in order to enable business success for NetApp. 

 

The successful candidate may be based in any of the following NetApp office locations: Amsterdam (EMEA HQ), Munich, Paris, or Greater London

 

Key Responsibilities:

           

  • EMEA Commercial Legal Leadership: Work with business teams/product teams to enable profitable business growth, including negotiating, drafting, or reviewing commercial agreements such as transactional/sales agreements, channel/ distributor agreements, ELA’s/ESA’s, managed services and consumption-type agreements, support and services agreements, RFP’s/ RFQ’s, license agreements,  marketing and promotional agreements, and other supply agreements.  Advise business clients in connection with new business initiatives/units, operations and product-related issues, especially with regard to software licensing and consumption / capacity business.
  • EMEA Field Legal Team Management: Manage and coach a team of high-performing legal professionals (lawyers and contract support providers), enabling it to continue to meet or exceed business needs and to provide development opportunities for the legal professionals.
  • EMEA Senior Leadership:  Be a member of the extended EMEA Senior Leadership Team and represent the legal department with regard to deal reviews and business conduct matters. 
  • Cross-Functional Collaboration and Coordination: As needed, coordinate and collaborate with colleagues in the legal department and across other NetApp functions and geographies in connection with specialized matters (e.g. corporate, compliance, tax, intellectual property, privacy, data protection, trade compliance and export control). 
  • Dispute Resolution: Work with business teams, and internal and external counsel to manage disputes and litigation claims.
Job Requirements

Functional Competencies:

  • Business Acumen: Strong understanding of business and commercial transactions, understands key business drivers, and conversant in key business financial metrics. Agile, strategic and flexible/creative thinker.
  • Solutions Oriented: Able to think critically about key business drivers and risk factors. Able to develop practical solutions to achieve business objectives within acceptable risk parameters.
  • Communication Skills: Solid written and oral communications skills. Able to communicate clearly and concisely at all levels, including to executives, junior staff and external stakeholders. Comfortable making executive-level presentations and able to positively influence multiple stakeholders.
  • Legal Skills: Strong understanding of legal concepts and how to apply to real-world situations. Excellent drafting skills, able to draft simple or complex legal documentation as needed. Able to learn new areas of the law and apply to NetApp’s business. Able to work with external legal counsels across diverse markets to synthesize legal advice and solutions that fit NetApp’s business.
  • Collaboration: Able to work as part of cross-functional teams and establish strong working relationships with key stakeholders in in EMEA, Silicon Valley and around the world.
  • Budgetary Control: Able to plan, account and manage assigned budget.
  • Self-Starter; Maturity: Able to operate with high degree of autonomy and handle ambiguity. Confidence to make recommendations. High level of integrity and professionalism.
Education

Education: Law degree (LLB) from a recognized university and called to the Bar in at least one EMEA jurisdiction, preferably the country of residence.

 

Experience: Minimum 12 years’ experience practicing law with leading law firm or in-house.  Experience in new business and contracting models strongly preferred, including Cloud services, Managed Services & Consumption, Data Storage Software, Data Protection & Security.  Significant experience with the in-house legal department of an MNC in the technology industry is also a plus.
